Attorneys for Ghislaine Maxwell, the former companion of deceased sex-offender Jeffrey Epstein, are asking a federal judge to keep a batch of court records under seal, arguing that public interest in the documents is outweighed by privacy considerations and the potential impact a release of the documents could have on an ongoing criminal investigation into alleged accomplices of Epstein.

“Ms. Maxwell … is aware that investigations surrounding the alleged conduct of Mr. Epstein survive his death. It is unclear who are witnesses or targets of any investigation,” Maxwell’s attorney, Jeffrey Pagliuca, wrote Wednesday in a filing objecting to unsealing certain documents. “The sealed testimony or summaries may inappropriately influence potential witnesses or alleged victims.”

The sealed court filings in the case — a now-settled civil defamation lawsuit filed against Maxwell in 2015 by Virginia Roberts Giuffre — are said to contain the names of hundreds of people, some famous and some not, who socialized, traveled or worked with Epstein over the span of more than a decade. The late financier has previously been linked to a coterie of high-profile business leaders, scientists, royalty and politicians.

Epstein, a convicted sex offender, was found dead in an apparent suicide in prison while awaiting trial on sex trafficking charges that he denied.

Among the records now being considered for release is a 418-page transcript of one of Maxwell’s multi-hour depositions in the case, which Maxwell’s attorneys argue were given under an expectation of confidentiality that had been agreed to by both sides in the dispute, according to Maxwell’s court filing.

“This series of pleadings concerns [Giuffre’s] attempt to compel Ms. Maxwell to answer intrusive questions about her sex life,” Pagliuca wrote. “The subject matter of these [documents] is extremely personal, confidential, and subject to considerable abuse by the media.”

The collection of documents now being reviewed for potential release by Senior U.S. District Court Judge Loretta Preska represents just a small subset of the thousands of pages of documents that must be reviewed for potential release, a process that could drag on for many months.

Giuffre has accused Maxwell of facilitating and participating in Epstein’s abuse of minor girls. Maxwell has denied Giuffre’s allegations. When the defamation case was settled in 2017, a substantial portion of the court docket remained sealed or redacted. The sealed records include the identities of people who provided information in the case under an expectation of confidentiality, plus the names of alleged victims and individuals accused of enabling Epstein or participating in the abuse.

Maxwell attorneys argue that the bulk of the sealed documents and exhibits should stay sealed, contending that they “were gratuitous and served no legitimate purpose” when they were submitted by Giuffre’s attorneys and because many of the documents contain the names of dozens of non-parties who have yet to receive notice that the records could be made public.

An attorney for Giuffre did not respond to a request for comment on Maxwell’s court filing.

Giuffre, now a 36-year-old mother living in Australia, alleges she was sexually abused as a teenager by Epstein and Maxwell between 2000 and 2002. She also claims to have been directed to have sex with some of their prominent friends, including Britain’s Prince Andrew. She filed the action against Maxwell in September 2015, alleging that the former British socialite defamed her when her publicist issued a statement referring to Giuffre’s allegations as “obvious lies.”

For the next year and a half, attorneys for the two women engaged in an acrimonious duel of pre-trial arguments, much of which took shape in heavily redacted or sealed court filings. The case settled just before a trial was set to begin in May 2017. A year later, the Miami Herald newspaper filed an ultimately successful motion to unseal at least some portions of the undisclosed record of the case.

Lawyers representing Giuffre, Maxwell, the Herald, and an anonymous individual who intervened to assert privacy interests, have been haggling for the last several months over their favored approaches to unsealing the records. The arguments over the protocols alone amounted to more than 50 additional entries on the court docket before Judge Preska arrived at the final procedure.

Earlier this month, notification letters were sent to two “John Does,” anonymous individuals whose names are among several dozen that appear in just the first batch of sealed and redacted documents currently under review by Preska, according to court records. Neither of those individuals responded to the letters, according to Maxwell’s court filing.

Giuffre has advocated for near-total disclosure of the records, while Maxwell and attorneys for the intervening individual have urged Preska to carefully balance the intense public interest in the case against potentially “life-changing” reputational damage that could befall those whose names are made public. Because the parties reached a confidential settlement, the allegations leveled in the dispute are unproven, having never been tested by an independent trier of fact.

Previously unsealed records from the case have already generated headlines around the world after a federal appeals court released more than 2,000 pages of documents last August, a month after Epstein’s arrest by federal authorities in New York.

Included in that collection were excerpts from Giuffre’s depositions naming several prominent men she alleges Epstein and Maxwell directed her to have sex with, including Prince Andrew, attorney Alan Dershowitz, former U.S. Senator George Mitchell and former New Mexico governor Bill Richardson. All of those men, and others accused by Giuffre, have denied the allegations.

“The documents and exhibits should be carefully examined for the vivid, detailed and tragic story they tell in the face of cursory, bumper sticker-like statements by those accused,” Giuffre’s attorney, Sigrid McCawley, wrote in a statement on the day of the documents’ release. “Virginia Roberts Giuffre is a survivor and a woman to be believed. She believes a reckoning of inevitable accountability has begun.”

The morning after that first set of documents was made public, Epstein was found unresponsive in his jail cell in Manhattan, where he was being held pending trial on charges of child sex-trafficking and conspiracy.

Maxwell, 58, is the daughter of the late British publishing magnate Robert Maxwell, who died in 1991 in what was ruled an accidental drowning off the coast of the Canary Islands. She met Epstein in New York following her father’s death, and the two were closely linked for more than a decade. Sources tell ABC News that Maxwell remains under criminal investigation by federal authorities in New York, who have vowed to hold responsible any alleged co-conspirators in Epstein’s sex trafficking conspiracy.

In previously unsealed excerpts from her depositions in the case, Maxwell derided Giuffre as an “absolute liar.” She has also denied allegations from Giuffre and other women who contend in court filings that Maxwell recruited and trained girls and young women for Epstein and facilitated their abuse.

“She absolutely denies that she participated in this or any other sexual abuse or trafficking or assault, and no court, judge or jury has ever determined that she has,” an attorney for Maxwell wrote last month in a related case.

Install Latest Chrome Update to Patch 0-Day Bug Under Active Attacks

Google yesterday released a new critical software update for its Chrome web browser for desktops that will be rolled out to Windows, Mac, and Linux users over the next few days.

The latest Chrome 80.0.3987.122 includes security fixes for three new vulnerabilities, all of which have been marked ‘HIGH’ in severity, including one that (CVE-2020-6418) has been reportedly exploited in the wild.

The brief description of the Chrome bugs, which impose a significant risk to your systems if left unpatched, are as follows:

  • Integer overflow in ICU — Reported by André Bargull on 2020-01-22
  • Out of bounds memory access in streams (CVE-2020-6407) — Reported by Sergei Glazunov of Google Project Zero on 2020-01-27
  • Type confusion in V8 (CVE-2020-6418) — Reported by Clement Lecigne of Google’s Threat Analysis Group on 2020-02-18

The Integer Overflow vulnerability was disclosed by André Bargull privately to Google last month, earning him $5,000 in rewards, while the other two vulnerabilities — CVE-2020-6407 and CVE-2020-6418 — were identified by experts from the Google security team.

Google has said CVE-2020-6418, which stems from a type confusion error in its V8 JavaScript rendering engine, is being actively exploited, although technical information about the vulnerability is restricted at this time.

The search giant has not disclosed further details of the vulnerabilities so that it gives affected users enough time to install the Chrome update and prevent hackers from exploiting them.

A successful exploitation of the integer overflow or out-of-bounds write flaws could allow a remote attacker to compromise a vulnerable system by tricking the user into visiting a specially crafted web page that takes advantage of the exploit to execute arbitrary code on the target system.

It’s recommended that Windows, Linux, and macOS users download and install the latest version of Chrome by heading to Help > “About Chrome” from the settings menu.

Here’s their top tips for avoiding phishing scams online.

• Many phishing scams originate overseas and often the spelling, grammar and punctuation are poor. Others will try and create official-looking emails by including logos and graphics. Is the design (and quality) what would you’d expect from a large organisation?

• Is it addressed to you by name, or does it refer to ‘valued customer’, or ‘friend’, or ‘colleague’? This can be a sign that the sender does not actually know you, and that it is part of a phishing scam.

‘You could see he wasn’t looking after himself and was dropping out of the university system. He was always following a very strict diet eating only vegetables and fruit and he had been following this for some time, it started in December 2016.

‘He had this fixation with this diet and it got worse and worse and eventually he was taking supplements and all sorts of things. It appeared this diet was more from the internet and social media and was taking information from American websites.

‘I did ask him where he got all this from, he was quite assertive that he believed this information to be true, but it was from oddball websites and books.

‘We were very, very concerned about his well being, not so much his mood, more his irrational behaviour, he was sleeping until the afternoon, and when he was talking it was nonsensical.

‘He believed he had physical problems with his bones and this culminated in a meeting with his GP. The main thing was the diet. I requested a meeting to see if any counselling could be offered but it wasn’t available.

‘I funded private counselling and he attended three sessions, but he wasn’t responding to that and it was stopped. 

‘On 29th September 2017 he was admitted to hospital and I met him for lunch and he looked like he had gone insane.

‘He was completely out of reality, he was in his own little bubble. He was completely exhausted he couldn’t focus. He kept saying on many occasions he was going die and that his disease was consuming him physical and mentally. 

‘He did say to me occasionally “I have just had enough, I want to end things”, but these were fleeting comments, he didn’t say how or when.’

Mr Mathews’ mother Sylvia Duncan, a nurse said: ‘He was always a very friendly little boy and when he was growing up he really enjoyed his food, and there was one point when I was going to London to see my sister and brother in law when he declared he was going pescatarian.

‘He once told me “I want to make sure everybody’s healthy and I want to open my own enterprise, I want everybody to know about healthy eating”. He was never a fussy eater, he ate everything and enjoyed cooking.

‘He started the pescatarian diet where he cut out just meat, then he started to cut out certain types of food including carbohydrates and protein. He kept saying: “I don’t need protein I have been told I don’t need it”.

‘I noticed he was losing weight, he was having to eat more frequently as he wasn’t taking in anything of substance. He was coming up with arguments from people he met online and he was eating just greens and fruit which he mashed it up.

‘As I am a nurse I understand nutrition but he was telling me people who had written books which he purchased told him to get better you had to deteriorate a little bit first.

‘I tried to say that it doesn’t make any sense but he was adamant that they knew what they were talking about. 

‘I think this diet was linked to his knowledge of food. But I think he accessed the wrong information from Google which sent him in the wrong direction.

‘I remember him coming home and showing me his knees and he said there was something wrong and I said it was because of his weight loss because of the diet he had been following.

‘I said it was because of the diet but he said he had spoken to some woman in America and she told him it was because he wasn’t following this diet correctly. He said he was worried if he didn’t get back on track something was going to happen.

‘His GP referred him to the early intervention team and prescribed anti anxiety medication and sleep medication.’

The inquest heard Mr Mathews was admitted to the Norbury Ward at Stepping Hill Hospital in September 2017 after further concerns about his mental condition. 

He died after buying supplements from a Holland and Barrrett store during a period of leave.

Leanne Callan of British Transport Police said: ‘Officers attended the ward at Stepping Hill and recovered a laptop and sent it to the high tech crime unit in London. I am aware the family did have concerns regarding access to websites and the dark web and things like that.

‘The interrogation unit were asked to check if William had been accessing any dark web material but there was no such usage of the dark web.

‘They were able to access a number of word documents. There were three documents of interest, one called “final note”, one called “suicide note” and a third called “the way”. All were created on various dates in September, the last document was “the way”, which was modified on 04/10 at 9.23am. 

‘These were the three documents which were deemed to be critical in the investigation.

‘From the evidence on the CCTV and the train driver’s statement, we believe that William deliberately entered the tracks on his own, there was no third party involvement, and deliberately placed himself in front of the train.’

Austria’s foreign ministry is facing a “serious cyber attack”, it said late Saturday, warning another country could be responsible.

“Due to the gravity and nature of the attack, it cannot be excluded that it is a targeted attack by a state actor,” it said in a statement with the interior ministry shortly before 11.00 pm (2200 GMT), adding that the attack was ongoing.

“In the past, other European countries have been the target of similar attacks,” it continued.

Immediate measures had been taken and a “coordination committee” set up, it said, without elaborating.

The attack came as Austria’s Greens on Saturday gave the go-ahead to a coalition with the country’s conservatives at a party congress in Salzburg, removing the last obstacle to the unprecedented alliance.

Abstract/Description

The global food system will need to produce food more efficiently and sustainably to achieve the Sustainable Development Goals (SDGs) and meet the 2°C climate commitments of the Paris Agreement. As climate change affects food systems, governments, food and agriculture companies, and public and private investors need to better identify and address the numerous climate- related risks they face. This can also be an inflection point to take advantage of new investment opportunities that the transformation to low-carbon and resilient food systems presents. Climate-smart investments to transform food systems, however, are not yet at scale. This will require addressing core market failures to unlocking private sector financing from food and agriculture companies, domestic and international financial institutions, and specialized investors. Whilst this paper highlights the clear need and role for the former, it explores in greater depth innovative strategies to address the core market failures of the latter: 1) lack of deep pipeline of bankable projects, today; 2) high investment risk and lack of primary data/information asymmetries; and 3) lack of intermediation to efficiently connect different pools of capital to investment. Against this backdrop, CCAFS and its partners highlight a diverse set of policy options, innovative financial solutions, and strategies for how government, food and agriculture companies, public and private donors and investors can support the transformation to low-carbon and resilient food systems.
